Rules & Regulations

RESIDENT AND RESIDENT’S OCCUPANTS AND GUESTS MUST COMPLY WITH ALL WRITTEN RULES, REGULATIONS AND POLICIES PERTAINING TO THE PREMISES AND THE APARTMENT COMPLEX. THESE RULES AND REGULATIONS ARE SPECIFICALLY INCORPORATED INTO YOUR RESIDENTIAL LEASE AGREEMENT.

1. Parking

Resident is authorized to park one (1) vehicle within the Apartment Complex. Resident agrees to inform Landlord of any vehicle changes, including a new vehicle, change in license plate, etc. All vehicles must be properly registered, currently licensed (In-Transit signs will be honored for the legal 30-day period), and in operable condition. Any vehicle that remains stationary for a 72-hour period or more and are in violation of the above stated conditions will be subject to being towed at the owner’s expense after a 24-hour notice has been left on the vehicle or Resident’s Premises.

a. Permits

Parking Permits should be placed in the following locations depending upon the Apartment Complex:

  • Argosy Apartments: Lower corner of the front windshield on the passenger side;
  • Cherrywood Apartments: Hung from the rearview mirror;
  • Stony Ridge Apartments: Hung from the rearview mirror;
  • Sutter Place Apartments: No permit required; or
  • Aristos Apartments: No permit required.

b. Towing Policy

The parking lot(s) within the Apartment Complex are reserved for residents only between the hours of 10:00 pm and 6:00 am. Any vehicle, whether it belongs to a resident or not, without a proper Parking Permit will be subject to being towed during the aforementioned time period, at the expense of the Resident or their guest. Vehicles that are improperly parked (e.g. taking up more than one space, parked in a handicap spot without proper identification, etc.) with or without a parking permit, are subject to being towed at any time of the day.  Landlord will not be held responsible for any towing costs or damages from such removal.

c. Prohibitions

Vehicle repairs or washing are not permitted in the parking lot(s) or garages, unless a designated car wash station is indicated within the Apartment Complex.

2. Smoking

a. Definitions

No Resident shall smoke, nor permit anyone to smoke, in the Resident’s Premises. Smoking shall be prohibited in common hallways, stairways, foyers, laundry rooms, storage or package rooms, office, fitness room, and garages

b. Designated Smoking Areas

Smoking shall be permitted outside on the Apartment Complex grounds except anywhere that is designated as a smoke-free area including, but not limited to, the pool area if applicable. This shall include a resident’s patio or balcony. All cigarette butts MUST be disposed of properly.  Any damage caused by improper disposal of cigarette butts will be charged back to the responsible Resident. Resident shall inform Resident’s occupants and guests of the no smoking rule.

c. Damages

Resident understands and agrees that any damage caused by or related to cigarette, pipe, or cigar smoking, or any ignitable product shall not constitute ordinary wear and tear. Landlord may deduct from Resident’s Security Deposit for all damages and/or costs for the cleaning or repairing of any damage caused by or related to any tobacco product, including, but not limited to:  deodorizing the apartment, sealing and painting the walls and ceilings, and repairing or replacing the carpet and/or pad.

d. Disclaimer

Resident acknowledges the following: 1) that the enforcement of the no smoking rule shall not make the Landlord a guarantor of the Resident’s health or of the smoke free condition of the Resident’s Premises and the common areas in the Apartment Complex; 2) the enforcement of the no smoking rule shall not, in any way, change the warranty of habitability; and 3) that Landlord’s ability to police, monitor, or enforce the no smoking rule is dependent in significant part on compliance by the Resident and Resident’s guests. Landlord specifically disclaims any implied or improved air quality standards than any other rental property. Landlord cannot or does not warranty or promise that the rental premises or common areas will be free from secondhand smoke.

3. Keys

Upon termination of the Lease, all keys/fobs shall be returned to Landlord or Resident will be charged any applicable costs, including re-keying the unit, building, mailbox, etc., as well as the costs of new keys for residents in the other units if the building must be re-keyed. Resident will also be responsible for any lock, key/fob and labor charges if locks must be changed during occupancy due to loss or damage caused by Resident.

a. Related Fees

If Resident locks themselves out of the building, apartment, or garage, contact the office or emergency maintenance phone number during non-office hours. Landlord reserves the right to unlock the unit or furnish a duplicate key at a convenient time and place determined by Landlord. The following charges will apply and are to be paid at the time of the lock out:

  • $20.00 during office hours as established by the Apartment Complex;
  • $35.00 during nights and weekends; and
  • $45.00 on holidays.

4. Miscellaneous

Resident hereby agrees to use or maintain the Premises or Apartment Complex as follows:

a. To use the highest degree of care to keep the premises safe, clean and sanitary, and to comply with applicable standards of the Housing and Building Codes. To use all electrical, plumbing, heating, ventilating, air-conditioning, and other facilities in a reasonable manner, and to use appliances only for their intended use.

  1. Dishes should be well rinsed before being placed in the dishwasher.
  2. Do not put grease, peels, large quantities of food, or paper products down the garbage disposal or use it in lieu of a trash can. If you are unsure if something should or should not be put down the garbage disposal, err on the side of caution and throw it away instead.
  3. Do not use products such as “Easy Off” and “Mr. Muscle” on the stoves as they may damage the finish and the thermostats.
  4. Do not use products such as “Drano” or “Liquid Plumber” as they can damage the plumbing and you will be charged for the repairs.
  5. Do not dispose of sanitary napkins, wipes (even if they are advertised as “flushable,” or other such products in the toilets. These products will plug the plumbing and you will be charged for the cost of unplugging it. If your toilet does overflow, shut the water off immediately. The turn-off is behind the toilet. Plunge the toilet firmly and quickly. If this fails, call maintenance.

b. To conduct himself/herself and all guests in a manner which will not disturb his/her neighbors’ peaceful enjoyment of the premises and to assure that the conduct of all guests or pets is in such a manner that will not harass, embarrass, or needlessly make complaints to Landlord. Parties are not allowed.

c. To not keep pets or animals of any kind on the premises without written consent of the Landlord.

d. To not make any changes, remodel, redecorate, or paint.

e. To not install any additional major appliances, including but not limited to, portable washers and dryers, without the prior written approval of the Landlord. If allowed, Resident agrees to pay additional utility costs for same.

f. To not attach to or hang from the walls anything weighing more than one pound without written consent of the Landlord. Small nails may be used, but do not use adhesive on the walls, or nails in the woodwork or cabinets.

g. To refrain from littering on the premises.

h. Resident is responsible for any minors living in or visiting the unit and must supervise them on the grounds at all times.

i. To pay for all repairs resulting from his/her misuse of Premises by Resident, his or her family, guests, or pets.

j. Not to act or use the Premises in any way that would be deemed hazardous by the insurance carrier.

k. To store personal property such as bicycles, autos, motorcycles, boats, trailers, etc. only in areas specifically approved by Landlord. Bicycles are not to be stored on the patio or balcony. If your property has a bike garage you may get a key from the rental office.

l. To promptly notify Landlord of any known need for repairs to the dwelling unit or premises. Evert effort will be made to handle these requests as quickly as possible. Please limit evening and weekend calls to emergencies only!

m. To not store any items in the furnace closet, prop the furnace closet doors open, or block air intake vents outside of the furnace. Failure to comply can result in a fire that endangers not only your life, but the lives of others in the building. Anyone who fails to adhere to the policy will be held responsible for any damages resulting.

n. To not prop the building entry doors, laundry doors, or fire doors open at any time and to not allow entrance to anybody that is not your guest. Soliciting is not permitted.

o. To not display any signs, flags, or exterior lights or markings on the Premises or within the Apartment Complex (this includes any signs, flags, banners, or markings displayed in any windows); provided, however, Resident may display the traditional flag of the United States or a flag from an officially licensed vendor for the University of Nebraska from his or her patio or balcony, not to exceed 3 feet by 5 feet.

p. To not keep personal belongings in the hallways.

q. To keep grounds and patios clean and tidy at all times and agree not to store or hang rugs, laundry, clotheslines, or other household items on the patio or balcony.

r. To observe posted rules (listed below and/or posted directly in the room/area) for the use of the laundry room, clubhouse, fitness center, and/or swimming pool to the extent these facilities are included within the Apartment Complex.

s. To cooperate with Landlord in keeping the unit free of rodents and other pests. To permit entry and spraying (or other measures required for pest control) by Landlord or a pest control company. Residents may be liable for pest control costs.

t. To maintain and replace smoke detector batteries and light bulbs, excluding florescent lights, which shall be the sole responsibility of the Resident. Resident shall notify Landlord immediately of any deficiencies.

u. To not install a satellite dish, or any other fixture that must be attached to the property, without the written consent of the Landlord.

v. To not install any surveillance cameras or recording devices outside of Resident’s unit that interferes with another tenant’s privacy. Any cameras or devices must be wireless and not require any drilling or electrical work. Resident agrees to pay for any repairs or repainting needed after the removal of the same.

w. To not store or use fire pits, charcoal grills, or propane grills with a water capacity more than 2.5 pounds (nominal 1-pound LP-gas capacity on the premises, except those that are provided for resident use in common areas, to the extent included in the Apartment Complex. Electric grills are permitted. Resident will be responsible for any fines/fees issued by the City Fire Inspector. Please refer to the City of Lincoln Fire Code for any questions.

x. To observe the following rules relating to fire pits and fire places located in the common area, if applicable:

  1. The fire pit/place hours will be posted and may vary seasonally.
  2. The fire pits/places are first come first serve, however please be courteous to other residents and do not monopolize them.
  3. Noise levels must be kept low not to disturb others. Offensive and abusive language will not be tolerated.
  4. No glass or other breakable containers are allowed.
  5. Use of the fire pit/place requires adult supervision at all times. Fire safety is to be practiced.
  6. Residents will be responsible for the proper use of the fire pit/place or be held liable for any and all damage caused by all household occupants and their guests.
  7. Any issues with the grill malfunctioning must be immediately reported to the Owner.
  8. Violations of the policies for use of the fire pit may result in termination of the privileges for use.

y. To observe the following rules relating to outdoor grills located in the common areas, if applicable:

  1. Outdoor grill hours will be posted and may change without notice at any time.
  2. The outdoor grills are first come, first serve. Please be timely and courteous to other residents waiting to use the grill.
  3. Must be 18 or older to use the grill.
  4. Do not leave the grill unattended.
  5. Residents must finish grilling 30 minutes prior to the closing time to allow the grill to cool. Turn off all burners when finished grilling.
  6. The grill is gas-fueled. Use of charcoal or lighter fluid will damage the grill. Residents are responsible for cleaning the grill including any applicable racks, grates, lids, adjacent burners, grease baskets or exterior finishes. Failure to properly clean grill and BBQ area will result in a minimum $50.00 cleaning charge.
  7. Resident(s) will be responsible for any damages that may occur.
  8. Any issues with the grill malfunctioning must be immediately reported to the Owner.
  9. Violations of the policies for use of the grill may result in termination of the privileges for use.

z. To not have water-based furniture (e.g. waterbed, aquarium) without written consent of Landlord.

aa. If storage units are available at the Apartment Complex, they may be rented, for an additional monthly fee.

  1. Belongings are stored at Residents risk. Landlord has no liability whatsoever for loss or damage to Resident’s property stored in the storage unit whether by fire, theft, vandalism, insects, or weather.
  2. Resident is responsible for securing personal property.
  3. Flammable or environmentally hazardous materials or food or other recyclable goods which could attract vermin are not permitted in storage units.
  4. No improvements or alterations shall be made to the storage space without the consent of Landlord. Landlord reserves the right to inspect the storage space at any time for emergency purposes or upon at least twenty-four (24) hours’ notice to Resident for any other purpose.

5. Pool Area Rules and Regulations

To the extent that a pool is included within the Apartment Complex, Resident hereby agrees to observe the following Rules and Regulations and any signs posted at the Pool Area:

a. Pool facilities are for the enjoyment of Residents and their guests. Resident must accompany guests at all times. The number of guests may be limited at the discretion of Landlord.

b. Outdoor pools will be open seasonally only, to be determined by Landlord. Pool hours are posted at the pool. The pool may be closed from time to time for pool maintenance or for reasons otherwise deemed necessary by Landlord.

c. There is no lifeguard on duty. Swim at your own risk. Swimming alone is not recommended.

d. Landlord is not responsible for accidents, injuries, or loss of personal property.

e. Proper swimming attire must be worn at all times in or around the pool area. Children who are not toilet trained must wear swim diapers.

f. Children must be accompanied by an adult at all times.

g. No glass or other breakable containers are allowed in the Pool Area. No food is allowed in the pool.

h. All trash must be disposed of properly.

i. No smoking is permitted in the Pool Area.

j. No pets are allowed in the Pool Area.

k. No urinating, defecating, or expulsion of bodily fluids permitted in the Pool Area.

l. Pool furniture is not to be removed from the Pool Area.

m. Be respectful to fellow Residents. Diving, running, pushing, rough-housing, disorderly, or otherwise dangerous behavior is not permitted. Resident is responsible for the behavior of their guests and any damages they may cause.

n. Landlord reserves the right to refuse entry to the Pool Area to any Resident or guest who, in their judgement, is in violation of the rules and regulations, appears to be under the influence of alcohol and/or drugs, or appears to have a contagious or infectious condition.

o. Any Resident in violation of Pool Area Rules and Regulations are subject to suspension of pool privileges and/or further action, up to and including eviction.

Stony Ridge Apartments Pet Policy

Stony Ridge Apartments welcomes cats. There is a $150 non-refundable fee for one cat and a $250 non-refundable fee for two cats. Only two cats are allowed per apartment.

Pet rent is $25/month per pet.

Rabbits and ferrets are not permited at Stony Ridge Apartments.

Argosy Apartments Pet Policy

Argosy Apartments welcomes cats and dogs. There is a $150 non-refundable fee for one pet and a $250 non-refundable fee for two pets. Only two pets are allowed per apartment.

Pet rent for cats and dogs 35 pounds or less is $25/month per pet. Pet rent for dogs over 35 pounds is $35/month per dog.

Large dogs are permitted on the first floor and all dogs 35 pounds or less are permitted on all floors. Cats are permitted on all floors.

Breed Restrictions: Akitas, Alaskan Malamutes, Cane Corso, Chows, Doberman Pinschers, German Shepherds, Great Danes, Mastiffs, Pit Bulls, Rottweilers, Huskies, Wolf Hybrids, or any other breed designated by the Landlord.
